These Terms of Service ("Terms") govern access to and use of Pepperland GSC MCP and related internal Google API reporting components (collectively, the "Tool"), operated by Pepperland Marketing ("Pepperland," "we," "us," or "our"). By accessing or using the Tool, you agree to these Terms. If you use the Tool on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
## 1. Purpose and authorized users
The Tool is an internal reporting and analysis service used to retrieve and analyze data from authorized Google Ads accounts and Google Search Console properties. It is available only to Pepperland employees, approved contractors, and other users expressly authorized by Pepperland and the applicable account or property owner. The Tool is not offered as a public, self-service application.
## 2. Authorization and account access
You may connect or use only Google accounts, Google Ads customer accounts, and Search Console properties that you own or are expressly authorized to access. You authorize the Tool to request and use the Google permissions displayed during the applicable authorization process for the purposes described in these Terms and our Privacy Policy.
You are responsible for maintaining the security of your Google Account and for promptly notifying Pepperland of suspected unauthorized use. You may revoke Google Account authorization at any time through [Google Account third-party connections](https://myaccount.google.com/connections).
## 3. Permitted use
Subject to these Terms, Pepperland grants authorized users a limited, revocable, non-exclusive, non-transferable right to use the Tool for legitimate internal business purposes, including reporting, diagnostics, budget pacing, quality checks, performance analysis, and preparation of optimization recommendations.
The Google Ads component is read-only. It does not create accounts or create, edit, pause, or delete campaigns, ads, keywords, budgets, or other Google Ads resources. Any action taken in a Google account after reviewing Tool output must be performed separately by an authorized person.
## 4. Prohibited use
You must not:
- access an account, customer, property, or data without authorization;
- share credentials, tokens, nonpublic Google data, or Tool access with unauthorized persons;
- use the Tool or its data for unlawful, fraudulent, deceptive, discriminatory, or abusive purposes;
- use Google data for surveillance, unrelated advertising, retargeting, personalized advertising, credit or lending decisions, or sale to data brokers or information resellers;
- attempt to bypass Google, Pepperland, or provider security controls, rate limits, permissions, or technical restrictions;
- reverse engineer, disrupt, damage, overload, or introduce malicious code into the Tool or related services;
- misrepresent the Tool as sponsored, endorsed, or operated by Google; or
- use the Tool in violation of applicable law, Google's terms and policies, an account owner's instructions, or Pepperland's policies.
## 5. Google and third-party services
The Tool depends on services provided by third parties, including Google APIs and OpenAI Codex. Your use of Google services remains subject to Google's applicable terms, policies, account settings, and permissions. Use of Codex is subject to Pepperland's applicable OpenAI agreement and organizational settings.
Google and OpenAI are independent service providers and are not parties to these Terms. Pepperland is not sponsored or endorsed by Google. Third-party services may change, restrict, suspend, or discontinue their APIs or features, which may affect the Tool.
## 6. Privacy and Google user data
Our [Privacy Policy](https://www.pepperlandmarketing.com/google-api-reporting-tool/privacy) explains how the Tool accesses, uses, stores, shares, and deletes information. By using the Tool, you acknowledge those practices and agree to provide any notices or obtain any permissions required from the relevant account or property owner.
Pepperland's use of information received from Google APIs will comply with the [Google API Services User Data Policy](https://developers.google.com/terms/api-services-user-data-policy), including its Limited Use requirements.
## 7. AI-assisted output and human review
The Tool may use artificial intelligence to summarize data and generate analyses or recommendations. AI-assisted output may be incomplete, inaccurate, or unsuitable for a particular decision. It is not a substitute for professional judgment. You are responsible for reviewing source data, validating material conclusions, and obtaining appropriate authorization before acting on Tool output.
The Tool does not guarantee advertising performance, lead volume, enrollment outcomes, conversion results, regulatory compliance, or any other business result.
## 8. Confidentiality and data responsibility
Google account data and Tool output may contain confidential or commercially sensitive information. You must handle that information according to the account owner's instructions, Pepperland policies, applicable agreements, and law. You may disclose it only to persons authorized to receive it.
You remain responsible for the legality, accuracy, and appropriateness of data, prompts, instructions, and materials you provide to the Tool.
## 9. Intellectual property
Pepperland and its licensors retain all rights in the Tool, including its software, workflows, documentation, and branding. These Terms do not transfer ownership of Google data, client data, or third-party materials. Rights in reports and deliverables created for a client remain governed by the applicable client agreement.
Feedback voluntarily provided about the Tool may be used by Pepperland to maintain or improve it without obligation, provided that Pepperland will not use Google user data for a new purpose without any notice or consent required by law or Google's policies.
## 10. Availability and changes
We may maintain, modify, suspend, restrict, or discontinue any part of the Tool. We do not guarantee uninterrupted or error-free operation, continued availability of any third-party API, or preservation of any particular feature. We may impose reasonable usage, security, or access limits.
## 11. Suspension and termination
Pepperland may suspend or terminate access if a user violates these Terms, poses a security risk, loses authorization to an account or property, or if suspension is necessary to comply with law or provider requirements. You may stop using the Tool and revoke Google authorization at any time.
After termination or a valid deletion request, Pepperland will handle stored credentials and Google API data as described in the Privacy Policy. Sections that by their nature should survive termination—including confidentiality, intellectual property, disclaimers, limitations of liability, and governing law—will survive.
## 12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOOL AND ITS OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." PEPPERLAND DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
## 13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PEPPERLAND AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE TOOL, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
PEPPERLAND'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE TOOL WILL NOT EXCEED THE AMOUNT PAID TO PEPPERLAND FOR THE TOOL DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. Any separate written agreement between Pepperland and the relevant organization controls to the extent it expressly conflicts with this section.
## 14. Governing law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Tool will be brought in the state or federal courts located in Connecticut, unless a separate written agreement requires a different forum or applicable law provides otherwise.
## 15. Changes to these Terms
We may update these Terms as the Tool, law, or provider requirements change. We will post the revised Terms with an updated effective date. Continued use after the revised Terms take effect constitutes acceptance, except where additional notice or consent is required by law.
